1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you and Goldenvale Senior Living ("Company," "we," "us," or "our") concerning your use of our website and senior living services located at 156/9 Chaeng Watthana Road, Pak Kret, Nonthaburi, Thailand.

By accessing our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.

2. Definitions

  • "Services" refers to all senior living accommodations, care services, and related offerings provided by Goldenvale
  • "Resident" means an individual who has entered into a residency agreement with Goldenvale
  • "Family Member" refers to authorized representatives or next of kin designated by a Resident
  • "Website" means our online presence accessible at goldenvar.live

3. Services Description

Goldenvale provides senior living services including:

  • Trial Stay Experience (short-term accommodations)
  • Garden Cottage Residence (independent living)
  • Supportive Living Suite (assisted living with personal care)

Service availability, specific features, and pricing are subject to change. Current offerings are described on our website and in individual residency agreements.

4. Residency Requirements

Age and Capacity

Residents must be 60 years of age or older. All residency agreements must be entered into by individuals with legal capacity to contract, or by their authorized legal representatives.

Assessment

Prior to admission, prospective residents undergo a health and needs assessment to determine appropriate service levels. We reserve the right to decline admission if we cannot adequately meet an individual's care requirements.

5. Payment Terms

Fees

Service fees are specified in individual residency agreements and are payable in Thai Baht (฿). Payment is due monthly in advance for ongoing residence, or upfront for trial stays.

Late Payment

Fees not received within 10 days of the due date may incur late payment charges. Continued non-payment may result in service suspension or termination of residency.

Refunds

Refund policies vary by service type and are detailed in residency agreements. Generally, trial stays are non-refundable once commenced. Monthly residence fees may be prorated in case of early departure with appropriate notice.

6. Resident Responsibilities

Residents and their representatives agree to:

  • Provide accurate health and personal information
  • Respect other residents, staff, and community property
  • Follow community guidelines and safety protocols
  • Notify staff of changes in health status or care needs
  • Maintain respectful behavior toward all community members

7. Our Responsibilities

Goldenvale commits to:

  • Provide services as described in residency agreements
  • Maintain safe and clean facilities
  • Employ trained and qualified staff
  • Respect resident privacy and dignity
  • Coordinate with healthcare providers as needed
  • Communicate regularly with designated family members

8. Limitation of Liability

While we take all reasonable precautions to ensure resident safety and wellbeing, Goldenvale is not liable for:

  • Medical outcomes resulting from conditions existing prior to residency
  • Personal property loss or damage (residents are encouraged to maintain personal insurance)
  • Unavoidable incidents despite reasonable safety measures
  • Acts of nature or circumstances beyond our reasonable control

Our liability is limited to the amount of fees paid for services during the preceding three months.

9. Healthcare Disclaimer

Goldenvale is a residential care facility, not a medical facility. While we coordinate with healthcare providers and assist with medication reminders, we do not provide medical diagnosis or treatment. Residents remain under the care of their personal physicians.

10. Termination

By Resident

Residents may terminate residency with 30 days written notice. Trial stays may be ended early without penalty, though fees are non-refundable.

By Goldenvale

We may terminate residency with 30 days notice if: (1) resident's care needs exceed our capabilities, (2) resident behavior poses safety risks to others, (3) fees remain unpaid despite reasonable notice, or (4) mutual agreement that alternative arrangements better serve the resident's needs.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Thailand. Any disputes arising from these Terms or our services shall be resolved in the courts of Nonthaburi Province, Thailand.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting to our website. Continued use of our website or services after changes constitutes acceptance. Significant changes to existing residency agreements will be communicated directly to affected residents and their families.
